Pengertian Mahkamah Agung – The Supreme Court is the highest organ of law in the United States and many who feel that they have not been favored appropriately by a ruling of the lower courts can seek redress from the Supreme Courts. There are those who feel that the wheel of justice has gone a full cycle after seeking legal opinion of the Supreme Court in respect to a previous ruling where the new ruling is more on their favor and those who feel a heavy burden after the Supreme Court either throws out their requests or hands down a more harsher sentence.

Discussed herein are recent Court rulings

Supreme Court Splits on Ten Commandments- Recorded on 27th June, 2005.

On this date, the Court made a ruling that the showcasing of the Ten Commandments is in line with the country’s constitution and can be used in the Texas Capitol Building. Nonetheless, the same cannot be displayed in the Kentucky courthouse. The Supreme ruled that the show casing of the Ten Commandments in Kentucky Court House was in violation of the separation of religion and state, a clause clearly stated within the First Amendment. Legal experts propose that the recent rulings were in line with enabling the courts some flexibility in establishing the constitutionality in show casing the Ten Commandments on public building.

Supreme Court Supports Governments authority to take possession of private land- Recorded on June 24th 2005.

Recently the Court ruled that the government’s decision to take possession of private land was in line with the constitution. This extends to homes and commercial buildings when it is extremely necessary to develop structures such as malls, housing estates and office parks. The Court made a ruling that Cities had the powers to take over private property if it is in the interest of economic growth. But, this can only be done after a fair reimbursement has been made to the property owner involved.

While making his ruling, the judge, Justice John Paul Stevens stated that, “Promoting economic development is a traditional and long accepted function of government”. In addition, Justice Sandra Day O’Connor stated that, “Any property may now be taken for the benefit of another private party, but the fallout from this decision will not be random.” She went on to state that, “The beneficiaries are likely to be those citizens with disproportionate influence and power in the political process, including large corporations and development firms.”

Other judges who seconded the rulings made by the two counterparts were Chief Justice William H, Rehnquist as well as Justice Antonin Scalia.

There are more recent Rulings that have been made over the years that have one way or the other influenced the way of life in today’s society.
